What It Means Athlete Rights

What is NIL?

Name, Image, and Likeness (NIL) refers to your legal right of publicity. It allows student-athletes to earn compensation when their name, photo, video, social media presence, or personal endorsement is used for commercial or promotional purposes.

However, NIL is not "pay-for-play." Compensation cannot be tied directly to athletic performance (such as points scored) or used as an improper recruiting inducement by a school.

Golden Rule: Always disclose partnerships to your school's compliance office or state athletic association before signing.

5 Questions to Ask Before Signing Any Deal

Use this interactive compliance checklist before agreeing to any brand partnership.

1. Does this conflict with my school or team sponsors? Ensure you aren't wearing competing apparel during official team activities or using protected school logos without permission.
2. Are the exact deliverables and dates clearly written? Know exactly how many posts, hours, or appearances are required, and on which platforms.
3. Is there an exclusivity clause that blocks future deals? Check how long the brand prevents you from working with other companies in the same category.
4. Who owns the content and image rights after the campaign ends? Never sign away perpetual ("forever") rights to your likeness for a one-time small payment or free product.
5. Have I reported this agreement to my compliance department? Filing your disclosure form protects your eligibility on the court.
